Privacy Rights Notice

 

          1.   This cable system collects and maintains the following personally

                 identifiable information concerning subscribers:

                                        

                       *Order and installation records

                       *Billing records

                       *Service, maintenance and repair records

                       *Premium service subscription information

                       *Marketing Information

                       *Subscriber complaints

 

          2.   The following persons have access to such information when necessary in                  connection with our business. Access is as often as necessary, and may be on

                 a day-to-day basis:

 

                       *Cable system employees

                       *Cable system sales agents

                       *Business which provide services to the cable system, such as our accountants

                       *Program services, who periodically audit subscription information                                                   *Representatives of the franchising authority

 

           3.  The cable system will not maintain such information after it is no longer

                 necessary for carrying on our business.

 

           4.   As a subscriber, you may review any personal information held by us which                  pertains to you. You must give 3 business days notice of your wish to review

                 such information, in order to give us an opportunity to locate and, if necessary,

                 prepare such information for review. (Preparation is sometimes necessary to

                 avoid disclosure of information relating to other subscribers.)  If you wish to

                 review your personal information, please contact us by letter or telephone to

                 arrange for a review.

 

           5.   You may request correction of any errors in personal information which we           

                 collect or maintain pertaining to you.

 

           6.  We may not use the cable system to collect any personally identifiable

                 information except as is necessary to carry on our business or to detect theft

                 of services, unless you consent. ( We do not presently us e the cable system to

                 collect and such information other than information necessary to carry on our                  business or detect theft of service.)

 

           7.  We may not disclose personally identifiable information except as is

                 necessary to  carry on our business except as set Put in Paragraph 8 below,

                 unless you consent or unless we are required to do so by court order. We do

                 not presently disclose personally identifiable information except as is necessary

                 to carry out on our business. These disclosures are listed in Paragraph 2.

 

           8.  We may disclose your name and address for mailing of guides, program

                 notices, or other purposes, unless you tell us you do not wish us to disclose it.                  Disclosures of names and addresses will not be in a form that discloses the

                 extent of any use you make of services we provide.  If you do not wish to have

                 your name and address disclosed, or if you wish to limit the circumstances in

                 which we disclose it, please request and complete a Non-disclosure of Name and

                 Address   form from our business office.

 

          9.  Any person aggrieved by any act of a cable operator in violation of this section

                  may bring a civil action in a United States District Court.

 

10.  If we are served with a court order requiring disclosure of personally identifiable information concerning a subscriber we will inform the subscriber before ant information is released. Under some circumstances, a governmental entity may seek a court order to obtain personally identifiable information from the cable system concerning a cable subscriber. The subscriber must be given an opportunity to contest issuance of such an order.

  • Acceptable Use Policy

    · The Service is for residential use only within a single household. Customer agrees that only the Customer and residents living in the same household or employed by the business will use the Service. The term ‘single household’ means the Customer’s home and includes an apartment, condominium, flat or other residential single unit that may be used as a residence in any multiple dwelling unit.  The Service is being provided only for residential use in Customer’s household and any unauthorized access by a third party of the Service relieves TV Cable Company of Andaluisa, Inc. of any obligations. Customer is responsible for any misuse of the Service that occurs through Customer’s account whether by a member of Customer’s household or an authorized/unauthorized third-party.

     

    · If the service is provided for a commercial account, the Service is provided for the use in Customer’s business only.  Any unauthorized third party access to any Service relieves TV Cable Company of Andalusia, Inc. of any obligations.

     

    · Customer will not use, or allow other to use the service to send unsolicited messages or materials, bulk e-mail, or other forms of solicitation, and/or use TV Cable Company of Andaluisa, Inc. in any attempt  to mislead the recipient.

     

    · Customer will not use, or allow others to use, the Service to transmit computer “viruses,” worms, “Trojan horses,” denial of service attacks or other harmful software programs or information containing any lock, key, bomb, worm, or other harmful feature. Customer is responsible for using standard practices to prevent the transmission of such viruses, or other harmful software and information. As software or other content downloaded from the Service may contain viruses, it is Customer’s sole responsibility to take appropriate precautions to protect Customer’s computer from damage to its software, files and data.  TV Cable Company of Andalusia, Inc. is not responsible for providing or supporting any antivirus software.

     

    · Customer will not use, or allow others to use, the Service to send or receive, or otherwise use any information which infringes the patents, trademarks, copyrights, trade secrets or proprietary rights of any other person or entity. This includes, but is not limited to, digitization of music, movies, photographs or other copyrighted materials or software. Customer must obtain appropriate authorization from such other person or entity prior to sending, receiving or using such materials. TV Cable Company of Andaluisa, Inc. assumes no responsibility, and Customer assumes all risks regarding the determination of whether material is in the public domain, or may otherwise be used for such purposes.

     

    · If TV Cable Company of Andaluisa, Inc. receives a notice from a copyright owner alleging any Customer has committed copyright infringement, TV Cable Company of Andaluisa, Inc. will disrupt service and attempt to notify the Customer of the alleged infringement. Once Customer has been notified, service will be restored. If or when TV Cable Company of Andaluisa, Inc. determines that a Customer is a repeat copyright infringer, TV Cable Company of Andaluisa, Inc. reserves the right to terminate the accounts of repeat copyright infringers without prior notice.
